Dare god i'm soooooo glad i quit these rat bastards.

If you have not already heard, Walmart has decided to take $470,000 from Debbie Shank, a 52 year old mother of three (One of her sons recently died in Iraq), who was involved in a terrible car accident crippling her short term memory, leaving her in a wheelchair, and in a nursing home.

Because of the fine print of Walmarts health insurance plan, since Debbie was involved in a car accident and was awarded the money to take care of the tragic aftermath, they are entitled to take all the money that was supposed to go to taking care of Debbie.

THEY ACTUALLY WANT $470,000 from this handicapped woman in a wheelchair, who needs it to be taken care of in the future. This coming from a company that made $90 billion last quarter...

Luckily up here in Portland Wal-mart doesn't have the stranglehold it does elsewhere. In some towns there just isn't any other option to get a lot of stuff. They are really asses about this, no question about that.

I know it's nice to blame wal-mart... but really...

They could have sued for complete medical coverage paid by the trucking company. Sounds like a lawyer was a little lazy.

Shank should sue their lawyer for the 470,000 dollars.

Wal-mart backed down after the public outcry over the story got to critical mass. I personally was offended by this story - this poor lady needs the money for her care, Wal-mart does not.

Are you saying it's fair for Wal-Mart to pay for all of the medical expenses after she already sued the trucking company for twice the cost of the medical expenses?

It might be a common corporate practice but that doesn't make it right or even fair in all cases - the lady had brain damage and needed long-term care for the rest of her life. After lawyers fees, they had around $415,000 left, and Walmart wanted most of that, leaving her with a miniscule amount (about 5% of the million she won) to live off the rest of her life. Will $40,000 last long when you're in a nursing home? A year at most.

The policy may be there and it may have been legal, but that hardly makes it right. Wal-mart tried to make it sound like they had no choice - but they did and if it hadn't been brought to light they would have gone forth with it. Talk about heartless corporate machination.

Had the lady not been brain damaged and needing continuing care, I would be inclined to give a little more credence to their case, but come on, have a little heart. They probably paid as much in legal fees as that family had left just trying to get their precious money back. Ridiculous.

Wal-mart did have a choice, but it would be a choice between what their legal paperwork expressly says, or between paying out hundreds of thousands of dollars to a woman who was hung out to dry by her lawyer, essentially giving a big middle finger to everyone who has ever received standard Wal-Mart coverage in the past. Yes, it's unfortunate and subjectively pretty slimy, and Wal-Mart would have probably received some pretty good publicity if they just donated a chunk of it back to her. But the outcry just seems misplaced considering her lawyer already made out with more than what this dispute is even worth :shrug

Sigh...unfortunately, The Mart of Wal is the social hub of my entire county - and the only place to get most of the stuff they sell. The closest gaming store is what...an hour away? ;_;
